Julius Malema is facing a possible 15-year prison sentence after prosecutors argued for the maximum penalty following his conviction on firearm-related charges linked to a 2018 political rally.

The leader of the Economic Freedom Fighters appeared in court this week as sentencing proceedings continued. Prosecutors told the court that a custodial sentence was appropriate given the seriousness of the offences.

Malema was found guilty in October 2025 of unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a public place, and reckless endangerment. The charges relate to an incident where he fired a rifle during a rally attended by thousands of supporters.

The State has pushed for a 15-year sentence, arguing that the case requires accountability, particularly because of Malema’s position as a public figure and lawmaker. Prosecutors said failure to impose a strong sentence could set a negative precedent.

During court proceedings, the prosecution highlighted that Malema’s actions were carried out in a public setting and could have influenced his supporters. They stated that leaders should be held to a higher standard under the law.

Malema has denied wrongdoing throughout the case, maintaining that the firearm used during the rally was a toy and that no harm was intended. His legal team has argued for a more lenient sentence, including the possibility of a fine instead of imprisonment.

The court has not yet delivered a final sentence, and proceedings were adjourned to allow further consideration. Malema has indicated that he will appeal any sentence handed down.

If a prison sentence exceeding 12 months is confirmed and upheld on appeal, Malema could lose his position as a Member of Parliament. This would have significant implications for his political career and the EFF.

Supporters have gathered outside the court during proceedings, showing backing for the EFF leader as he awaits the outcome. The case has drawn national attention due to Malema’s role as one of South Africa’s prominent opposition figures.

The offence carries a potential maximum sentence of 15 years under South African law. However, the court retains discretion to impose a lesser penalty depending on mitigating and aggravating factors presented during sentencing.

The case stems from a 2018 rally where Malema fired multiple rounds into the air during a party celebration. The incident was widely circulated and later formed the basis of the charges brought against him.
