Dr Nandipha Magudumana Mourns Mother’s Death While in Custody, Funeral Plans Underway

Dr Nandipha Magudumana’s mother, Nokuzola Sikeleni, has died while she remains in custody awaiting trial. Authorities say she may apply for compassionate leave to attend the funeral. Legal and psychological support measures are being arranged during this period.

Dr Nandipha Magudumana is mourning the death of her mother, Nokuzola Sikeleni, who passed away on Thursday in Port Shepstone while Magudumana remains in custody awaiting trial.

The death comes as Magudumana is being held at Bizzah Makhate Correctional Services, where she has been detained since her arrest. The loss has added emotional strain during an already difficult period as she prepares for ongoing legal proceedings.

Speaking to Sunday World, her father, Zolile Sikeleni, confirmed the passing of his wife and said that funeral arrangements are currently being made. He expressed deep sadness that his daughter is unable to be with the family during this time of mourning.

Magudumana’s legal representative, Machini Motloung, said steps have been taken to support his client during this period. He confirmed that efforts are underway to ensure she receives psychological assistance as she deals with the loss of her mother.

Motloung also called on authorities to keep Magudumana informed about developments related to her mother’s funeral. He said it is important that she is updated on arrangements and given appropriate support while in custody.

According to Singabakho Nxumalo, there is a possibility that Magudumana could be granted compassionate leave to attend the funeral. Nxumalo explained that such provisions are available under South African law for inmates facing bereavement.

Nxumalo said the Department of Correctional Services assists offenders who lose immediate family members by allowing them to apply for temporary release. He said this process is guided by legal provisions designed to balance humane treatment with security considerations.

“In terms of the Correctional Services Act, 1998 (Act No. 111 of 1998), Section 44(1)(a) provides that a sentenced offender may, subject to prescribed conditions, be allowed to leave the correctional centre for a period determined by the National Commissioner in order to maintain family ties or for other humane purposes,” Nxumalo said.

He added that each application is assessed carefully, taking into account factors such as the offender’s risk classification, behaviour in custody, and security concerns. He said the system is structured to ensure both compassion and public safety are maintained.

Magudumana’s current detention follows her arrest in April 2023 in Arusha alongside her then partner, Thabo Bester. The two were taken into custody after being located outside South Africa.

She is accused of helping Bester escape from prison in May 2022 by faking his death in a prison cell fire. Since their arrest, both have remained in custody as legal proceedings continue in connection with the case.
